This course provides an in depth
understanding of the Legal Issues that
Physical and Occupational Therapists face. Discussion
is included for: the 4 sources of Law
in the United States, the difference between
civil and criminal law, how our court system
works, and definitions of common terms such
as tort, negligence, malpractice, plaintiff,
standard of care, and expert witness.
Learn how to protect from being sued for
negligence, assault and battery, invasion of
privacy, breach of confidentiality, false
imprisonment, or trespass to land. Discussion
on the components and benefits of obtaining
your own professional liability insurance,
requirements for informed consent,
guidelines for documentation, and what to do
if you are sued. Actual court
cases increase the therapist's
understanding. In this age when
lawsuits are prevalent in the medical
setting, this course will greatly aid the
practicing therapist in how to protect
oneself against litigation. (This
course utilizes the text Legal and
Ethical Issues in Health Occupations by
Tonia Dandry Aiken, RN, BSN, JD).
